Do I need approval?

The short answer is, Maybe..

In NSW there are 3 ways to gain approval.

  1. Exempt Development
  2. Complying Development (CDC)
  3. Development application (DA)

Exempt Development means no approval is needed. Exempt Development is low impact development and can be done in certain zones. Examples of Exempt Development include, Decks, Garden shed, Carports, fences, machinery sheds and farm sheds. For a development to be exempt from approval, it needs to meet strict specific standards and requirements to your site zoning, size of development, height, location and more.

Complying developments means approval is given by a private certifier or Council appointed certifier. This is usually a faster process and can be approved in as little as 10 days. This also needs to meet strict specific standards and requirements criteria. In short, Complying means you comply with the rules given. Examples of Complying development include, House Extensions, decks over a certain size, New homes, Sheds over a certain size and more.

If you do not meet these requirements, your development cannot be exempt or complying and requires approval in the form of a DA.
